Terms and conditions
1. Information on how to enter and the prizes form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these terms and conditions.

How to enter
3 Entry is only open to residents of Victoria. Entrants under the age of 16 must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. The Promoter may require an entrant to produce identification and proof of age.
4 Employees of the Promoter or any related body corporate and their immediate families are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5 At 10.00am 05.08.20 AEST the Promoter will begin keeping count of the number of bowls ordered through the official Bowl’d app at both of the Bowl’d locations (Frankston and Mornington Pop Up).
6 Orders must be placed via the official Bowl’d app to be counted.
7 Only items from the ‘Bowls’ section of the Bowl’d app’s menu will be counted.
8 The competition will cease in each location after the one thousandth (1000th) bowl has been ordered and delivered.
9 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
10 This is a game of chance and skill plays no part in determining the winners.
11 The Promoter will award the following prizes:
(a) $AUD 1000.00 cash to the thousandth bowl ordered at the Frankston location
(b) $AUD 1000.00 cash to the thousandth bowl ordered at the Mornington Pop Up location
12 The winners will be notified upon receiving their Bowl’d delivery.
13 The winners will receive their cash prize upon receiving their winning Bowl’d delivery.
14 Total prize pool is valued at $AUD 2000.00.
15 If a winner is disqualified in accordance with these terms and conditions or a prize remains unclaimed after reasonable efforts have been made by the Promoter to contact a winner, the winner forfeits the prize and the Promoter reserves the right to award the prize to another entrant as determined by the Promoter in its absolute discretion, subject to any directions from a regulatory authority
16 By accepting a prize, the winner agrees to participate in and co-operate as required with all reasonable marketing activities relating to the prize.
17 The Promoter's decision is final and the Promoter will not enter into correspondence regarding the promotion result or enforcement and interpretation of these terms and conditions (including disqualification).
18 By entering the Promotion, eligible entrants:
(a) consent to their photo and their name being made publicly available on the Promoter’s Facebook page, Instagram account; and
19 For the purposes of the Promotion, the entrant represents and warrants to the Promoter that the entrant is fit, healthy and able to fulfil its obligations as set out under these terms and conditions.
20 If for any reason this promotion is not capable of running as planned, including but not limited to COVID-19 lockdowns, government restrictions, tampering, weather event, earthquake, terrorism, unauthorised intervention, fraud, any technical difficulties or equipment malfunction or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to state regulation.
21 The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as part of the Promotion. To the extent permitted by law, the Promoter is not liable for any loss (including indirect and consequential loss) suffered to person or property by reason of any act or omission (including deliberate or negligent acts or omissions) by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods or services by any person to the prize winners and, where applicable to any persons accompanying the prize winners. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again.
22 Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
23 By entering into the Promotion the entrant consents to the Promoter using, modifying and disclosing the entrant’s name, likeness, image or voice (including photograph, film or recording) in any media (including making them available on the Promoter’s Facebook or other social media pages);
